AG Marty Jackley Takes Home Major Win for Life; Pam Bondi Needs to Follow His Lead and Do Better

South Dakota Attorney General Marty Jackley has done what U.S. Attorney General Pam Bondi refuses to do: Enforce state law against out-of-state Chemical Abortion Pill vendors illegally sending deadly pills across state lines. 

With the support of Gov. Larry Rhoden, Jackley issued a cease and desist letter December against New York-based Mayday Health for advertising Chemical Abortion Pills at South Dakota gas stations — illegal in the state. When Mayday Health refused to pull the advertisements, Jackley’s office filed a lawsuit against the business for its “deceptive and unlawful” advertisements. 

In a desperate attempt to continue killing South Dakota children, Mayday filed a federal countersuit in its pro-abortion home state, New York. A federal judge ruled February that the suit should be heard in state court, keeping the case in South Dakota where a trial date was set for July. 

Meanwhile, South Dakota’s legislature backed Jackley up by introducing the Students for Life Action (SFLAction)-inspired “Anti-Chemical Abortion Pill Trafficking Act” (HB1274) to impose criminal and civil penalties on Chemical Abortion Pill vendors distributing the deadly pills within the state — including out-of-state vendors sending them in the mail. The legislation passed the second chamber earlier this week and awaits Gov. Rhoden’s signature. 

The very same day another victory for South Dakota’s preborn babies and women was announced: The state of South Dakota and Mayday Health have reached a settlement. Mayday Health and its predatory advertising have been kicked out of South Dakota. 

“Mayday Health targeted women and young girls encouraging them to take abortion pills while misleading them about the physical risks,” Jackley said. “My position has been clear and unwavering, South Dakota law governs, and the misleading advertisements must be, and are, stopped.” 

This is exactly what state attorneys general should be doing: Refusing to cower to Big Abortion and enforcing legal protections for the lives and health of preborn children and women. 

Pam Bondi must take note. 

Pro-life states like South Dakota are being openly targeted by Chemical Abortion Pill vendors like Mayday Health — against both state laws and the Comstock Act. And states like California are enacting reckless shield laws to protect those who profit off the barbaric annual killing of more than half a million preborn children. 

“We cannot remain the United States of America when some states openly attack and celebrate the attacks on the lives and laws of people — born and preborn — in other communities,” Students for Life Action President Kristan Hawkins wrote in a letter to Trump Administration officials, including Bondi. 

If Bondi won’t do her job, state attorneys general must, with the support of their legislatures. 

AG Marty Jackley has set the example for attorneys general across the country to enforce their states’ pro-life laws against those preying on the most vulnerable in society. 

Bondi, follow his lead.
