
South Carolina re-introduces SFLAction’s “Human Life Protection Act” to protect LIFE from the moment of conception
The re-introduction of Students for Life Action’s (SFLAction) own “Human Life Protection Act” (H.3457) in South Carolina is giving legislators another chance to do right by preborn babies. Legislators failed to pass the “Human Life Protection Act” the last three legislative sessions—a serious stain on the state’s pro-life reputation.
“To restore a culture of Life in South Carolina, women must feel protected and supported,” SFLAction Kristan Hawkins wrote in a letter to South Carolina legislators. “The ‘Human Life Protection Act’ provides a common-sense way forward in how to abolish abortion for good, without compromising on principles that protect preborn children from their earliest days as well as mothers who are often the second-victim of the predatory abortion industry.”

While current South Carolina law illegalizes abortions at six weeks gestation, the “Human Life Protection Act” recognizes that it’s not enough—and seeks to rectify where legislators did not go far enough in protecting LIFE. The “Human Life Protection Act” is championed by SFLAction as the premiere pro-life legislation to protect preborn babies. Not only does the legislation recognize the personhood of preborn babies, but it also grants them full protections under the law.
The introduction of the “Human Life Protection Act” is a direct result of the tireless engagement efforts of SFLAction in South Carolina. Not only is the “Human Life Protection Act” SFLAction’s own legislation, we’ve also been activating students and volunteers for lobby days, engaging with constituents via door knocking campaigns, and pressuring state politicians to protect LIFE from the moment of conception.
Hawkins pointed to the replacement of two Republican senators in 2024 for betraying pro-life values as evidence that South Carolinians support the legislation. “In the ‘Human Life Protection Act,’ the legislature can provide historic protections for the most vulnerable preborn babies, something that the voters of South Carolina embrace,” Hawkins wrote.
The Big Picture:
- If passed, the “Human Life Protection Act” would be a HUGE win for LIFE in South Carolina, legally protecting ALL preborn children from the moment of conception!
- Taxpayers would not fund any abortions in South Carolina—another huge win for LIFE.
- Abortion vendors would be held legally responsible for any abortions they commit or attempt to commit. This would include Chemical Abortion Pill vendors in the state.
- This legislation does NOT prevent REAL healthcare, including ectopic pregnancy, miscarriage, and early delivery care.
- This legislation does not criminalize women who have abortions.
Bill Breakdown:
- “Person” is legally defined to include preborn children from the moment of fertilization, giving all preborn children full constitutional protections.
- State and federal funds—including publicly funded health plans—cannot be used for abortions (in South Carolina).
- Abortionists are held criminally and civilly liable. Committing or attempting to commit an abortion is classified as a felony, with penalties of up to 10 years imprisonment and or a fine up to $100,000. Women can take civil action against abortionists up to $10,000 per abortion with coverage of legal fees.
