Going After “Death by Mail”—Florida Legislature Joins Texas in Introducing Groundbreaking Legislation Allowing Family Members to Sue Over Chemical Abortion Pill

A new style of legislation in Florida, House Bill 663 (HB 663) and its companion bill Senate Bill 1374 (SB 1374), would expand the pro-life efforts in the state by targeting “Death by Mail,” the current business model of Chemical Abortion Pill pushers. The legislation would allow family members to bring lawsuits up to $100,000 against abortionists who break Florida law, including by mailing Chemical Abortion Pills into Florida. Florida law limits abortion at six weeks gestation. 

Building upon the momentum begun by Texas this past year, this groundbreaking style of legislation targets Chemical Abortion Pill vendors with civil liability lawsuits. Mothers and families of mothers who receive Chemical Abortion Pills and regret the abortion, abortion attempt, or receipt of Chemical Abortion Pills, or felt they were uninformed about Chemical Abortion Pills could sue the Chemical Abortion Pill manufacturer who shipped the Chemical Abortion pills for up to $100,000. $90,000 or more of this reward would go to specified nonprofits. 

“The rise of mail-order abortions endangers thousands of lives that would otherwise be protected by pro-life legislation,” said Students for Life Action President Kristan Hawkins. “With this new legislation, Florida has the chance to say ENOUGH to the Chemical Abortion Pill industry that has been operating above the law. Now is the time for states like Florida to join Texas in its innovative approach against the Chemical Abortion Pill industry and stand up for LIFE against this barbarism.” 

With legislation like HB 663, states can now stand up to Chemical Abortion Pill vendors civilly where there are not yet criminal liabilities for these vendors. We expect this style of legislation to continue making waves with future introductions of similar legislation in additional states.

The Big Picture: 

  • HB 663 allows for lawsuits of up to $100,000 against both abortionists operating in Florida and abortion vendors mailing Chemical Abortion Pills into Florida. 
  • This legislation acknowledges the effect of abortion on fathers and families by allowing for the fathers of unborn children and the family members of women suffering at the hands of abortionists to take legal action against the abortionists. 
  • Completing abortions, attempting abortions, and coercing women into abortions all qualify for lawsuits.

Bill Breakdown: 

  • Fathers of unborn children and family members of women hurt by abortionists (all defined as “family members”) can bring lawsuits up to $100,000 against abortion vendors. 
  • Family members can take legal action whether the woman consented to the abortion or not. 
  • Violation of Florida’s abortion law does not have to have originated in Florida. This means that abortion vendors who send Chemical Abortion Pills into Florida against Florida state law are held liable, even if the vendor resides in a state that allows for abortion. 
  • Coercion and attempted abortions in violation of Florida law qualify for lawsuits, along with completed abortions. 
  • Lawsuits must be brought within two years of the law violation. Florida law limits abortion at six weeks gestation. 
  • Clawback provision protects family members from legal action by out-of-state abortion supporters and vendors.

Representative Shane G. Abbott, District 5 (R) is sponsoring the bill (HB 663) in the House. His background as a pharmacist gives him further credit in pushing this legislation forward. Senator Jonathan Martin, District 33 (R) is co-sponsoring the bill (SB 1374) in the Senate. 

What We’re Watching: 

With the passage of the Students for Life Action-inspired “Women and Child Protection Act” in Texas and the introduction of HB 663 in Florida, look out for more state legislation targeting mail order abortions. As more states introduce civil liability legislation like the “Women and Child Protection Act,” SFLAction will continue to push for additional criminal liability for Chemical Abortion Pill vendors and federal regulations of Chemical Abortion Pills by HHS and the FDA.
