Louisiana Challenges FDA in First Hearing Against Chemical Abortion Pill Mailing into Pro-Life States

Louisiana just had its first hearing against the Food and Drug Administration (FDA) for their reckless rule that allows Chemical Abortion Pills to be prescribed and shipped into pro-life states by out-of-state telehealth doctors. 

Students for Life of America (SFLA) filed an amicus brief in this case in support of Louisiana. called on the FDA to live up to their promises and review the safety and environmental impacts of Chemical Abortion Pills.  

The case was brought by Louisiana Attorney General Liz Murrill to challenge a Biden-era deregulation of mifepristone, one of the two deadly drugs used in a chemical abortion, that allows them to be prescribed without the doctor ever seeing the patient in-person and shipping the pills into pro-life states in violation of their laws. 

“These are not doctors providing health care. They are drug dealers. They are violating our laws,” said Murrill

Mifepristone is used in Chemical Abortions to block a hormone called progesterone that maintains a pregnancy, effectively starving a preborn child in the womb. This is followed by misoprostol, which forces contractions to make the mother give birth to the sometimes still alive child.  

As reported by Louisiana Illuminator, U.S. District Judge David Joseph “is considering a request from Louisiana Attorney General Liz Murrill for a temporary injunction. She wants to end a 2023 U.S. Food and Drug Administration policy allowing mifepristone to be prescribed without an in-person doctor’s visit. FDA Commissioner Marty Makary is asking for Louisiana’s case to be delayed so his staff can complete a review of whether mifepristone is safe.” 

But it is already clear that mifepristone isn’t safe; more than 1 in 10 women who get Chemical Abortions have severe, life-threatening complications within 45 days of taking the pill. This is higher 22 times higher than the rate the lying Abortion Lobby tells women. 

And Abortion vendors are doing everything they can to perpetuate the lie. Danco Laboratories and GenBioPro Inc., two of the largest Chemical Abortion Pill vendors, called for the case to be thrown out altogether. Their argument? That siding with Louisiana would “open the door for states to challenge any federal policy they feel harms public health,” as reported by Louisiana Illuminator

What the results of the case will be remains unclear. The Louisiana Illuminator reports:  

“Joseph did not provide any indication when he might rule on Louisiana’s request for an injunction, though he gave the agency’s attorney seven days to file a brief explaining how the FDA would take emergency action if it’s discovered mifepristone presents a public health risk during the ongoing review process. … 

Noah Katzen, the FDA’s attorney, stressed multiple times in his arguments that Louisiana’s attempt at “judicial intervention” would disrupt the agency’s well-established drug review process. But he declined to provide a specific answer when Joseph pressed him for a firm timeline on when the review would be complete.” 

But Youth Voters want the dangers of mifepristone addressed now. A recent poll from Students for Life of America’s Demetree Institute for Pro-Life Advancementfound that 94% of Gen Z and Millennial voters want the FDA to review the safety of these pills with 31% calling it “extremely” important. 

The health impacts of chemical abortion pills and the laws of states protecting women from their disastrous effects matter.
