SFLAction Calls on the U.S. House Judiciary Committee to Repeal the FACE Act so that Peaceful, Pro-Life Americans Don’t End Up in Prison in Future Administrations

“The FACE Act was twisted into a political weapon by the Biden-Harris Department of Justice (DOJ), which targeted peaceful pro-life advocates while ignoring attacks on pregnancy resource centers and churches. Unless we act now, that can happen again,” said Students for Life Action President Kristan Hawkins. “It’s good news that the Trump Administration has made it clear that they won’t follow their precedent. But unless the FACE Act goes away, pro-life Americans will be targeted again.  It’s time to repeal this unjust law.”

WASHINGTON, D.C. (06-09-2025) Students for Life Action (SFLAction) President Kristan Hawkins calls on members of the House Judiciary Committee to support the FACE Act Repeal Act, introduced by Rep. Chip Roy (R-TX), as it heads to markup Tuesday, June 10th. The Freedom of Access to Clinic Entrances (FACE) Act was signed by President Bill Clinton in 1994, under the guise of preventing violence, but was weaponized by the pro-abortion Biden administration to silence and criminalize peaceful pro-life Americans—while turning a blind eye to escalating violence against pro-life pregnancy resource centers and organizations.  Under the Biden administration, peaceful pro-life advocates were dragged into federal court and sentenced to prison simply for praying or peacefully protesting near abortion facilities.

Hawkins has long called for an end to the prejudiced prosecution of pro-life Americans, especially in light of all the violence both experienced and ignored when pro-life Americans suffer.

As she wrote for Newsweek:

“Threats and acts of violence against pro-life activists are becoming increasingly common. Students for Life students and team members have endured everything from physical attacks and arson to bomb threats and intimidation, making security issues a vital concern and expense for pro-life events. When Justice Brett Kavanaugh—who was seen as a possible pro-life vote—was confirmed to the Supreme Court, protestors stormed the Supreme Court, banging on the doors. Outside the U.S., violent protests have broken out (like in Poland and Latin America) when those countries contemplated pro-life policies. Antifa has protested my own speaking tours …  Some abortion supporters are fighting for the violence of abortion with violent acts, which have a chilling effect on public discourse that must be overcome.

When people are afraid to use their free speech rights, those rights don’t truly exist.”

One of the most high-profile cases involved Mark Houck, a peaceful pro-life advocate who was arrested at gunpoint in front of his wife and children in 2022, accused of violating the FACE Act during sidewalk counseling outside a Planned Parenthood.

While he has been acquitted of all charges, he seeks to continue his legal battle against the U.S. Department of Justice (DOJ), seeking accountability for what he argues was a politically motivated and excessive use of force during his 2022 arrest.

In fact, 23 peaceful pro-lifers have also since been pardoned by President Donald Trump in his second term.

The law was written to protect all facilities involved in women’s health and reproduction, regardless of their stance on abortion. But in practice, it’s only been used to shield abortion vendors.

After the decision for Dobbs v. Jackson Women’s Health Organization was leaked, many pro-life pregnancy centers and organizations were brutally attacked across the country. Some of these include:

  • Mountain Area Pregnancy Services in Asheville, North Carolina, where windows were smashed and threats were spray-painted across the building.
  • The Capitol Hill Pregnancy Center in Washington, D.C., where the building was defaced with red paint, and the words “Jane Says Revenge” were spray-painted on the exterior.
  • The Oregon Right to Life office in Keizer, Oregon, where individuals ignited and threw 2 Molotov cocktails at the building.

“After the reversal of Roe v. Wade, it became painfully clear that the FACE Act became a blunt instrument of the pro-abortion Biden Administration to punish pro-life Americans for daring to speak out,” said SFLAction President Kristan Hawkins.

That’s why SFLAction urges Congress to repeal the FACE Act and put an end to the Biden administration’s dangerous two-tiered system of justice that punishes pro-life Americans while protecting violent abortion activists.
