Students for Life Action’s “Pregnant Students’ Rights Act” Introduced in the U.S. Senate

Students for Life Action’s model legislation fighting for resources & accommodations to be provided to pregnant & parenting college students has now been introduced in both chambers of Congress. 

“No student should have to choose between her child and her education, and, in fact, many services are in place for those who are building their families’ future at school. The least that we can do is simply share information with young families about all those ready to help,” said SFLAction’s Kristan Hawkins. “Any Democratic legislator who opposes this bill, hoping that young mothers will abort their preborn children, will be unmasked as a cold-hearted hypocrite, actively working against providing help for those in need and willing to hide hope and a future from those who want to succeed at school, at home, and in their career.” 

WASHINGTON, D.C. (01-14-2026) – Students for Life Action (SFLAction) is celebrating our model legislation now introduced in both chambers of Congress. The “Pregnant Students’ Rights Act” was introduced in the U.S. Senate on January 13, 2026, by pro-life champion U.S. Senator Ashley Moody (R-FL) after being successfully introduced in the House of Representatives last December by Representative Ashley Hinson (R-IA).

If passed, the “Pregnant Students’ Rights Act” would require colleges and universities to inform all enrolled and prospective students of their rights, resources, protections, and accommodations that would allow them to finish their education while bringing their pregnancy to term and then balancing school and family.  This would be a condition to receive Title IV funding. 

The introduction of the “Pregnant Students’ Right Act” is a direct result of SFLAction’s efforts to create and propose legislation that stands up for Life at all stages. The measure passed through the U.S. House last year, during the week of the National Pro-Life March but did not proceed in the U.S. Senate. 

SFLAction keeps track of pro-life legislation and scores sponsorship and votes in our Pro-Life Generation Report Card. This measure will be a scored vote and sponsorship. 

The measure introduced in the Senate is identical to the version introduced in the U.S. House’s 119th Congressional Session, which has been ordered to be amended. The Senate measure: 

  • Requires colleges & universities to inform enrolled and prospective students on their rights, resources, protections, and accommodation options for them to finish their education and carry their pregnancy to term in order to receive Title IV funding. 
  • Requires colleges and universities to instruct students on how to file a Title IX complaint with the Department of Education or their educational institution if her Title IX rights were violated. 
  • Requires this information to be made accessible to students through emails and digital communications, student handbooks, student orientations, university websites, and student health and counseling centers. 

As previously reported by SFLAction, Democrats have tried to hijack the bill with amendments requiring schools to push for pregnant students to abort their children. They don’t seem to comprehend that the bill is for pregnant students to be able to continue their education WHILE bringing their pregnancy to term. Death culture is so seeped into pro-abortion Democrats that they cannot fathom a student wanting to have their child and a degree, too.

This legislation modeled by SFLAction was first introduced in the Senate in 2023 by now U.S. Secretary of State Marco Rubio when he was serving as a Senator from Florida. It was read twice and referred to the Committee on Health, Education, Labor, and Pensions in 2023, and we are grateful to Secretary Rubio for supporting pregnant students and their preborn children.
