
Virginia edges toward adopting one of the most extreme abortion measures in the nation, with Democrats pushing the Old Dominion to have total dominion over the preborn.
The proposed Virginia Right to Reproductive Freedom Amendment would permit abortion through all nine months, effectively legalizing infanticide.

This measure would also prohibit any law that could “delay” or “burden” acc, which would nullify existing protections such as:
- Parental consent
- Informed consent & ultrasound requirements
- Health & safety regulations for abortion facilities
If passed, Virginia would have one of the most extreme abortion laws in the country, rivaling or exceeding places like New York, California, and Washington, D.C., putting them at odds with even most level-headed Democrats—though they may be few and far between. 75% of Americans (including most Democrats) support medical care for babies born alive during failed abortions. More than 70% of pro-choice voters oppose abortion in the third trimester.

Introduced as SJR 247 on November 25, 2024, the measure cleared the Virginia Senate by a razor-thin 21–19 vote on January 21, 2025. Just weeks later, the House followed suit, passing the resolution 51–46 on February 13, 2025.
This was a narrow push by abortion extremists determined to rewrite Virginia’s constitution and erase every protection for preborn children.
In order for this to become a ballot measure, it has to pass a second time in the legislature.
Currently, abortion is legal up to 26 weeks and 6 days in the Old Dominion—just before the third trimester. By putting abortion into the Virginia Constitution, this measure would block any future effort to restore common sense protections. This is more radical than Roe v. Wade ever was with no oversight, no limits, and no protections for viable babies.
Babies born at or after 21 weeks gestation have a growing chance of survival—with survival rates of 40–60% by 23–24 weeks and more than 70% after 24 weeks if provided proper medical care.
Extreme policies like this are not what most Virginians, especially moderates, want. It simply is not, nor ever has been, “The Virginia Way.” This amendment goes far beyond what most Virginians believe is acceptable. SFLAction will work to ensure that this amendment doesn’t happen.
Students for Life Action (SFLAction) and The Family Foundation of Virginia hosted a webinar, Protect Life Virginia, on Wednesday, August 13th which laid the groundwork for a “boots-on-the-ground” push leading up to Election Day on Tuesday, November 4.
Canvassing events will take place from September to Election Day throughout the state to flip at least two seats to make sure this measure does not make it to the ballot and become a part of the state’s Constitution.

As a pre-launch, on August 7th, 38 dedicated staffers from SFLAction knocked on nearly 1,000 doors throughout Virginia to ensure this measure does not pass. Expect to see more of us pounding the pavement for Life! With more canvassing days ahead before the November 4th election, flipping at least two seats will help stop this extreme measure. After all, change starts one door at a time.
