AMICUS BRIEF ALERT: FDA Failed to Protect the Endangered Species from Chemical Abortion Pills, says Students for Life of America

Amicus Brief filed in Federal Court in Louisiana’s Case against the Food & Drug Administration for Dropping the Ball in Protecting Both Lives & the Environment

“Once again, Students for Life of America calls out the FDA for failing to follow through and ensure that Chemical Abortion Pills are not also harming endangered species and the environment,” said Students for Life’s Kristan Hawkins. “Our amicus brief notes the ugly truth; that a fast-tracked, messy, and partisan approval of Chemical Abortion Pills ignored possible harms to endangered species. Precious human lives – preborn babies and their mothers – are lost to these deadly pills. That’s being ignored.  And no testing has taken place to find out what more than 50 TONS of abortion water pollution dumped each year does to endangered species. But no matter what happens in court, the Trump Administration still needs to address this deadly crisis.”

LAFAYETTE, LA (Western District of Louisiana) (02-13-2026) – Students for Life of America (SFLA) President Kristan Hawkins announced that the Pro-Life Generation would once again fight for preborn babies, mothers, and the environment in an innovative amicus curiae brief filed in one of the most significant abortion-related cases on the move today. SFLA will weigh in on the case, State of Louisiana v. U.S. Food and Drug Administration (FDA).The case is currently in federal court, in the Western District of Louisiana, where a request for a preliminary injunction is at play to go back to earlier health and safety standards for Chemical Abortion Pills. Chemical Abortion Pill pushers have asked to join the case, as they work to keep dangerous online, no test distribution of the deadly concoction for sale, without any protections for the women and girls buying or forced to take the drugs. 

“We know that online, no test distribution of deadly Chemical Abortion Pills makes all the wrong people happy – both pill pushes and abusers, who use them against women without their knowledge or consent. We also know that reckless distribution exposes women to injury, infertility, and death, as well as permits abortion water pollution,” said Hawkins. “In fact, other than abortion vendors, name another business allowed to flush pathological medical waste without any consequences. Endangered species are also being exposed to the active metabolites of Chemical Abortion Pills as a result of the reckless, unmonitored business of death-by-mail. This has to stop.” 

Our brief notes that there are nearly 1,500 endangered species in the U.S. that “depend on ecosystems within the United States that are impacted by human activity. Amicus SFLA and its members are concerned that the failure of the FDA to conduct consultation with the Services has led to irreparable harm to listed species and habitats and may lead to the destruction of some of these species.”

“Human lives and animal lives are risked by the negligent distribution of Chemical Abortion Pills,” said Hawkins. “The Trump Administration should act now to fully examine the harms of Chemical Abortion Pills and use the Comstock Act to end the kind of death-by-mail scheme that abusers just love.”

Students for Life’s Demetree Institute for Pro-Life Advancement annually surveys registered Youth Voters. This year’s Survey USA collaboration once again found that by margins of 9 in 10, the Youth Vote supports health and safety standards for Chemical Abortion Pills, now thrown away by agency neglect. 

In fact, we found:

  • Almost 9 in 10 (89%) support studies on the potential environmental impact of waste and drugs related to abortion, with 30% saying it is “extremely” important. Only 10% don’t want the government to investigate abortion water pollution.  
  • 94% said a federal review of Chemical Abortion Pill policy was important, with 31% calling it extremely important. Only 6% said it is not at all important.  
  • 90%  said it was important for those who distribute abortion pills to provide medical waste bags to collect the pathological medical waste and return it to the abortion vendor for legal disposal, with 33% saying it was extremely important.  
  • 92% believe it is “somewhat” to “extremely” important to have ultrasound screening to protect women’s lives when they are exposed to deadly Chemical Abortion Pills.
  • 94% support requiring providers to give women Rh blood tests to know about risks to future pregnancies, with 41% calling it “extremely” important.
  • Half of registered youth voters (50%) said that they would support in-person dispensing requirements (rather than anonymous, online distribution) to protect women from abusers using the drugs against them without their knowledge or consent. Only 27% opposed in-person dispensing, with 15% strongly opposing.
