Mississippi SECOND State in the Nation to Pass the Students for Life Action ‘Anti-Chemical Abortion Pill Trafficking Act’ This Session

JACKSON, MS. (04-01-2026) – Students for Life Action (SFLAction) President Kristan Hawkins celebrated the passage of House Bill 1613 (HB1613) in the Mississippi Senate, amended by Rep. Dan Eubanks (R), who sponsored the bill, to include language from SFLAction’s model legislation, the “Anti-Chemical Abortion Pill Trafficking Act.” The Senate advanced HB1613 by a vote of 24-7. Both chambers have now passed and concurred on the bill. It will now be sent to Gov. Tate Reeves’s desk for signature. If signed into law, Mississippi would become the second state this year to pass an “Anti-Chemical Abortion Pill Trafficking Act,” part of SFLAction’s push to end the nation’s most common method of abortion today. 

Mississippi’s pro-life laws embrace both mother and child, protecting Life completely, with provisions for abortion in cases of rape or incest or if a mother’s life is in danger. Pro-life doctors and medical professionals have been very clear that an abortion designed to end a baby’s life would not be employed for that purpose, though in maternal-fetal separation, the baby may not live after delivery in an attempt to save both lives. LEARN MORE HERE.

“Chemical Abortion Pill pushers have been clear that their intent is to violate laws like those in Mississippi, and they target pro-life states. By signing this bill, Gov. Tate Reeves can defend the lives of babies in the womb and his pro-life state law,” said Hawkins. “Mississippi has been innovative in taking down Big Abortion and going after those pushing Chemical Abortion Pills. This effort will continue the work of Attorney General Lynn Fitch, who successfully took down Roe v. Wade and has called for the Comstock Act to be enforced against Chemical Abortion Pill vendors due to the FDA’s flawed allowance of mailing the deadly pills.” 

Chemical Abortion Pills are used to commit more than 60% of abortions, killing hundreds of thousands of children and seriously injuring up to 1 in 8 mothers who use them. Pro-life states like Mississippi are being openly targeted by Chemical Abortion Pill vendors. 

The Mississippi legislature’s passage of HB1613 with the amendment based on SFLAction’s “Anti-Chemical Abortion Pill Trafficking Act” aligns with what voters want.

According to a January 2026 Students for Life’s Demetree Institute for Pro-Life Advancement poll conducted and released by Survey USA, half of the Youth Vote support protecting women from abuse with in-person dispensing requirements for Chemical Abortion Pills, with only 27% against. More than 9 in 10 support reinstating health and safety standards that have been stripped away from Chemical Abortion Pills, leaving women at risk for infertility, injury, death, and abuse by those who dose women with the deadly pills without their consent. 

And according to a February Cygnal poll, Republican voters want action on pro-life legislation, too, with 32% stating they are less likely to vote in the upcoming midterms if they feel the GOP is not addressing abortion. 

Here is what the HB1613 with the amendment inspired by SFLAction’s “Anti-Chemical Abortion Pill Trafficking Act” would do in Mississippi:   

  • Prohibit mailing, shipping, or prescribing Chemical Abortion Pills, including out-of-state sources. 
  • Enforce civil punishments up to $25,000 per violation, as well as a minimum of $5,000 and a year in prison, or a maximum of up to $50,000 and 25 years in prison, for trafficking Chemical Abortion Pills in Mississippi. 
  • Reinforce state sovereignty over medical regulation.  
  • Provide remedies including injunctive relief in damages per violation with no legal cap on rewards received and recovery of court costs and attorney’s fees. The bill excludes convicted abusers, traffickers, and rapists from bringing such civil actions.  
  • Allow civil actions to be filed up to three years after the cause of action or one year after any legal stay is lifted.
