The FDA’s willingness to see Human Beings Die — Preborn Babies & their Mothers — Seems Extended to Protected Endangered Species
“The FDA has ignored environmental law, failing to do the water testing needed to show that dumping tons of mifepristone-poisoned waste into our water isn’t risking the lives and fertility of endangered species, and there are more than 1,500 protected creatures in all 50 states,” said Students for Life’s Kristan Hawkins. “We’ve asked nicely. We’ve filed 11 citizen petitions to the FDA, begging them to follow environmental law and to protect babies, mothers, endangered species, and every American who does not want to be micro-dosed with a progesterone blocker. But the clock is ticking toward a lawsuit without action.”

WASHINGTON D.C. (09-24-2026) – Students for Life of America (SFLA) President Kristan Hawkins announced that its attorneys at First & Fourteenth have filed a notice of intent to sue the Food & Drug Administration (FDA) for failures to follow the “Endangered Species Act” (ESA) to address harm from a progesterone blocker to more than 1,500 protected creatures in all 50 states. Hawkins noted: “In 2000 at the beginning of the Clinton Administration, chemical abortion pills were forced on the U.S. market, with all kinds of promises made, promises broken by abortion promoters — all with the FDA’s rubber stamp, signing off on abortion profiteers’ claims about how ‘safe’ the deadly pills would be. Twenty-six years later, we know better.”
She continued: During the Obama and then Biden Administrations, the FDA relaxed their rigorous approval standard to speed the 2-pill abortion regime through the approval process — despite the fact that women also sometimes died and that healthcare workers’ conscience rights were violated as they attempted to save their patients. But just as mifepristone and mifepristone equivalents have been found in the water in Europe, a new study confirms their detection in U.S. water supplies. Studies worldwide have shown that aquatic and animal life can be impacted. You don’t have to be pro-life to want clean drinking water. And you don’t have to be pro-life to want endangered species protected from abortion-related water pollution. The shield of ESA regulation must be used to cover lives caught in the balance as a result of the FDA’s negligence.”
First & Fourteenth partner Lincoln Wilson explained that “the Endangered Species Act requires federal agencies to consult with fish and wildlife services before taking any action that may affect a listed or threatened species. And the scientific literature shows that mifepristone in water has adverse effects on wildlife, but the FDA never consulted on the matter. That means FDA’s actions for mifepristone, including approving abortion by mail, are void.”

As Students for Life’s Demetree Institute for Pro-Life Advancement polling has detailed, the registered Youth Vote cares deeply for the environment and wants to see it protected from abortion water pollution. The 2026 Survey USA Findings indicated:
- The GOP must protect the environment. Almost 9 in 10 (89%) youth voters support studies on the potential environmental impact of waste and drugs related to abortion, with 30% saying it is “extremely” important. Only 10% say it’s not important for the government to investigate abortion water pollution.
- The FDA needs to get busy. A massive 94% of youth voters said a federal review of Chemical Abortion Pill policy was important, with 31% calling it “extremely” important. Only 6% said it is “not at all” important.
Students for Life has made several asks of the FDA: To do the required environmental testing; to pull the deadly drugs from the market while the environmental testing is underway; to require REMS for biohazard bags for waste to protect humans and animals that may come into contact with abortion-contaminated water; and to refuse the pending request to relabel mifepristone for “miscarriage care” given the environmental concerns.
“We know that the abortion lobby is making a play to force mifepristone into every state as a ‘miscarriage treatment,’ giving abortionists a foothold no matter what laws protect life,” Hawkins noted. “That pending action demands an ESA review, as vulnerable lives will be threatened by supersized mifepristone and mifepristone-equivalent water pollution.”
Students for Life is also engaged in a campaign at the Environmental Protection Agency (EPA), asking that mifepristone be added to those pharmaceuticals tracked in accordance with the “Safe Drinking Water Act,” currently under review.
