Empower Grieving Parents in New Legislation: SFLAction’s Bereaved Parents Rights Act Introduced in U.S. House & Senate

“Processing the loss of a miscarriage is immensely difficult on its own, much more when parents who wish to bury or cremate their beloved baby face challenges from the hospital every step of the way,” said Students for Life’s Kristan Hawkins. “This bill will require families to be informed and equipped to mourn their miscarried baby, just as they do with any other loved one who tragically passes. As the abortion industry has tried to conflate tragic miscarriage with intentional abortion, it’s made things ever more confusing. We want grieving parents to get the help they need.”

WASHINGTON, D.C. (05-12-2026) – Students for Life Action (SFLAction) will celebrate the introduction of its model legislation, the “Bereaved Parents’ Rights Act” with an event on Wednesday, May 13th at the Heritage Foundation. This bill, sponsored in the Senate by Sen. Roger Marshall (R-KS) and in the House by Rep. Kat Cammack (R-FL), would require hospitals to notify and fulfill the rights of parents who experience a miscarriage who wish to arrange for their children’s memorial and burial or cremation, something that is often made difficult or impossible by the current mishmash of laws and practices state by state. The need for the bill is even more critical as a predatory abortion industry uses miscarriage as a talking point, leaving many confused and unsure of their rights.

SFLAction will be hosting a briefing event at the Heritage Foundation’s Van Andel-Gaby Center to honor bereaved parents and celebrate the introduction of this important bill. The briefing will be in-person and livestreamed at 10:30am ET on Wednesday, May 13th. 

Panelists will include SFLAction President Kristan Hawkins, bill sponsor Rep. Kat Cammack, Executive Director of Heaven’s Gain Ministries Donna Murphy, mother Sarah Wirtz, and birth & bereavement doula Laura Ricketts.

“Many hospitals throw away miscarried babies’ bodies like medical waste without consulting the parents, denying grieving parents the chance to memorialize their precious baby,” said Hawkins. “The Bereaved Parents Rights Act would right this immeasurable wrong by ensuring that every parent gets the opportunity to honor the life of their baby following a miscarriage as they see fit.”

Roughly 10 to 30 percent of pregnancies end in miscarriage or stillbirth, leaving countless families in heartbreak. They deserve the resources and ease that the “Bereaved Parents Rights Act” would provide.

If passed, the “Bereaved Parents Rights Act” would:

  • Notify the parent(s) of a miscarried or stillborn baby of their rights to a private or common burial, cremation, or disposal of remains by the hospital or birthing center within six (6) hours of the passing of their child or discharge.
  • Require the use of a standardized form of notification of these rights created by the Secretary of Health and Human Services to ensure proper notice.
  • Ensure proper arrangement for burial or cremation within 72 hours of the parent(s)’s written election following the same disposition options under their State’s law for fetal deaths.
  • Provide a private right of action in federal court should any individual not be denied or not notified of their rights under this act, allowing them to seek appropriate relief for violations.

Students for Life (SFL) has been active in pushing for legislation that will allow healing for parents and families suffering the loss of miscarriages. 

Following the briefing, SFLAction will head to Capitol Hill with students to lobby in favor of the bill.
