WASHINGTON D.C. (05-01-2026) – Pro-Life Americans celebrated news that the Fifth Circuit Court of Appeals has temporarily reinstated in-person distribution of Chemical Abortion Pills, cutting off abusers from anonymous, online purchases of drugs used against women without their knowledge or consent and disrupting businesses established to violate the pro-life laws of states like Louisiana, which brought the case. Students for Life of America (SFLA) filed an amicus brief in the case, noting that the dangers Louisiana identified also include potential harms to the environment.

SFLA President Kristan Hawkins noted that while this is good news, “it’s a fragile win, as another court could overturn the decision. We need more. We need the Trump Administration to commit to enforcing the Comstock Act, a law that says things used to end life in the womb by abortion should not be mailed.”

The appeals court panel stated the obvious — allowing Chemical Abortion Pills to be mailed into pro-life states with laws attempting to block that caused legal harm.
“Every abortion facilitated by FDA’s action cancels Louisiana’s ban on medical abortions and undermines its policy that ‘every unborn child is human being from the moment of conception and is, therefore, a legal person,’” the appeals court wrote Friday.
