On the floor of the U.S. Senate, Sen. James Lankford of Oklahoma gave an impassioned defense of preborn life while introducing the Born-Alive Abortion Survivors Protection Act. During his speech Sen. Lankford said, “In medical practices, in many states listed, the child is fully delivered during the abortion. And if the child cries or breathes, the practice is to back away and to allow the child slowly die on the table because the intent was an abortion.”
Later in his speech, Sen. Lankford noted that eight states have a requirement to report when a child survives an abortion and is delivered alive. “There were 277 cases of that” he said, before sharing the story of Melisa Ohden, who like others was featured in Students for Life of America’s recent Almost Aborted ad campaign, highlighting the powerful stories of abortion survivors.
It was quite jarring then when Sen. Dick Durbin of Illinois appeared to proclaim that because Kermitt Gosnell was once prosecuted for infanticide, it doesn’t happen. “Let me be clear that despite former President Trumps wild claims, it is not legal in any state to kill a child after it is born,” said Durbin. “Doctors already have an obligation under the law to provide appropriate medical care.”

Ignoring the fact that this isn’t true at all – as Sen. Lankford’s data shows – if it’s not happening as Sen. Durbin claims, why would the Democrats be opposed to legislation stopping it?
This life-saving legislation is not the only example of Democrats claiming something isn’t happening, yet will fight tooth and nail to stop legislation related to it. Take the SAVE Act for example, which would prevent illegal immigrants from voting in elections. Despite the obvious benefits of such a law, nearly all Democrats have voted against it.
History repeats itself. We have examples of the Democrats shamefully voting against the legislation to stop infanticide. In fact, Vice President Kamala Harris, then seneator, voted against a measure that would’ve provided lifesaving, humane treatments for abortion survivors. The reason? Harris argued it would “jeopardize the right to reproductive health care in our country.”
And to give another example proving that infanticide happens, data from the Minnesota Department of Health and additional reporting from the National Review showed that under Vice Presidential nominee Minnesota Gov. Tim Walz’s leadership, eight babies survived abortion attempts in Minnesota. On five occasions, no measures were taken to preserve life.
Their behavior would be considered confusing if the truth wasn’t so obvious – they know infanticide exists, and they want to keep it that way.
