Bob Ferguson to Sign Legislation Making WA State Nation’s Newest Chemical Abortion Drug Dealer

Olympia, W.A. (03-13-2026) — Washington State Gov. Bob Ferguson is expected to sign SB5917 into law, granting the state permission to get rid of its massive stash of Chemical Abortion Pills as cheaply as it chooses. The bill moved quietly to his desk on March 9 and is set for action on March 14.

In a statement, Students for Life Action (SFLAction) President Kristan Hawkins denounced the bill, saying, “It’s hard to believe that Washington state taxpayers wanted their hard-earned money wasted on a pile of Chemical Abortion Pills that Gov. Ferguson will try to move in a deadly fire sale. The irony of the Department of Corrections becoming drug dealers isn’t lost on me, but what we don’t know is whether Washington state might also be willing to violate pro-life state laws by shipping them from the Blue State to LIFE affirming Red States.”

Hawkins addressed the bizarre story in an opinion piece up at The Federalist, titled: “Washington State Giving Away $2M in Abortion Pills So Stockpile Doesn’t ‘Go to Waste.'”

She wrote, “To confront this kind of state-sanctioned pill pushing, the Trump Administration will need to step up. Step one would be to demand that the Department of Justice enforce the Comstock Act to ensure that Chemical Abortion Pills are not sent through the mail. Step two is to fast track the review of abortion pills at the Food and Drug Administration — that has been talked about from a lot of podiums but has yet to be seen. Step three would be to evaluate abortion water pollution.

“Washington’s original purchase was bad enough. But without this kind of federal intervention, this new legislation would turn the Department of Corrections into a full-blown, state-sanctioned drug dealer — and unless the state wants that title, it should reverse course.”

Washington State acquired its Chemical Abortion Pill stockpile in 2023, when former Gov. Jay Inslee, fearing pending litigation would take Chemical Abortion Pills off the market, instructed the state’s Department of Corrections (DOC) to use its pharmaceutical license to buy as many pills as possible. Under his instructions, the DOC purchased $2 million worth of Chemical Abortion Pills — over 155,000 doses worth — which Inslee planned on reselling to abortion vendors.  

Unfortunately for Inslee and Washington State, though, mifepristone has remained on the market — and the state’s abortion pills have sat in storage for years. But pills don’t last forever, and in January, 30,000 doses expired and had to be destroyed, meaning the state never recouped the money it spent.  

Now, the state has redoubled its efforts to sell its stockpile. Yet it found itself limited by law, which required it to resell the Chemical Abortion Pills at cost, a price that’s far higher than abortion vendors pay for the pills elsewhere. 

Hawkins noted: “The new law removes that limitation, allowing the state’s Department of Corrections to sell the abortion pills as cheaply as it wants — effectively enabling the state to give away thousands of doses of chemical abortion pills free of charge, turning it into the nation’s most affordable drug dealer.”
