Students for Life Action Rallies Behind West Virginia Legislation Targeting Chemical Abortion Pill Trafficking

The Students for Life Action-inspired “Mother & Child Protection Act” would stop Chemical Abortion Pill vendors from sending mail-order abortions across state lines in violation of West Virginia’s Pro-Life Laws

CHARLESTON, W.V. (01-14-2026) – Students for Life Action (SFLAction) students and volunteers are rallying today at the West Virgina statehouse in support of the “Mother & Child Protection Act,” introduced by SFLAction ally Senator Patricia Puertas Rucker, as part of an SFLAction-inspired effort to address the number one method of abortion in America today. If signed into law, the “Mother & Child Protection Act” would make illegal prescribing Chemical Abortion Pills, including out-of-state abortion vendors who mail the deadly pills across state lines. “SFLAction has been proud to work alongside Sen. Rucker to address this threat to precious West Virginia babies and their mothers. This is a human rights crisis soon to become a Constitutional crisis,” said SFLAction President Kristan Hawkins. “We cannot long remain the ‘United States’ when pro-abortion states actively work the facilitate breaking the law and ending the lives of citizens of their neighboring pro-life states. We will work with our friends and allies in West Virginia to protect Life in Law and fight all the way to the Supreme Court, if necessary.”   

Mail-order abortions make up more than 60% of all abortions committed, killing hundreds of thousands of preborn children and seriously injuring up to 1 in 8 mothers who use them. And Chemical Abortion Pill vendors are not shy about the fact they are targeting pro-life states   

The West Virginia law would illegalize all abortion, except in cases of sexual assault, incest, fetal nonviability, and medical emergency, making the state a prime target for Chemical Abortion Pill vendors.   

Here is what the “Mother & Child Protection Act” will do in West Virginia:   

  • Prohibits mailing, shipping, or prescribing abortifacients, including out-of-state sources. 
    Classifies committing or attempting to commit an abortion using an abortifacient as a felony punishable by up to 10 years’ imprisonment or a fine of up to $100,000.  
  • Reinforces state sovereignty over medical regulation.  
  • Provides remedies including injunctive relief, of $10,000 in damages per violation, and recovery of court costs and attorney’s fees. Excludes convicted abusers, traffickers, and rapists from bringing such civil actions.  
  • Allows civil actions to be filed up to three years after the cause of action or one year after any legal stay is lifted.

SFLAction’s push to get the “Mother & Child Protection Act” introduced and passed is part of our larger Make America Pro-Life Again Roadmap. Launched last November, this legislative package built upon the Gonzales v. Carhart case will help take down abortion at the state and federal level.
