The U.S. Supreme Court is expected to give major rulings this week that could change the landscape of abortion in America. One of these cases revolves around a regulation called EMTALA – the Emergency Medical Treatment and Labor Act –designed to require hospitals to stabilize all patients in the emergency room, regardless of their ability to pay.
However, according to a National Institute of Health (NIH) report from July 2022, the Biden Administration demanded that EMTALA require abortion care. This is what lies at the heart of the case being decided by the U.S. Supreme Court.
And if you want to see what this world looks like in practice, you only need to look at Poland.
According to reporting from NFP: “A hospital has been fined for refusing to provide a legal abortion in the first such case since the government recently introduced a requirement for publicly funded medical centres to offer such procedures.
Health minister Izabela Leszczyna announced on Monday that the Pabianice Medical Center was fined 550,000 zloty (€126,300). She revealed that audit proceedings regarding two other medical facilities are also in the “final stages” and that they are also likely to be penalised.”
The government has been going out of their way for some time now to inflict their will upon the Pro-Life Generation, hospitals in states with strict pro-life protections, and anyone else who takes a stand against this lawfare overreach.
As we’ve noted before, the current landscape for Chemical Abortion Pills is wildly dangerous for women and holds no prescribers or pill pushers to account. The women get the pills, walk away, and are left alone to deal with the potentially lethal consequences to themselves – and the lethal consequences to their preborn child.
The pills cause four times the complications as surgical abortion, with a risk of death that is ten times higher, according to a NIH study.
The FDA reports numerous side effects. Between 5 and 7% of women who take chemical-abortion pills will need a follow-up surgery to end the pregnancy. And an Australian study noted that up to 8% of women who took the pills in that country ended up in an emergency room. Similar math is even reported by the abortion industry.
Meanwhile, the Democrats are showing their priorities: stockpiling these dangerous Chemical Abortion Pills. According to Fox News: “Democratic and leftist groups are gaming out how to resist and prepare for former President Trump’s possible return to the White House, including blue state governors stockpiling abortion pills.”
But to what end? Are that many abortions expected if President Donald Trump wins re-election in November? Or will these pills be shipped – and by whom? Ultimately, the Comstock Act prohibits the mailing of abortifacients – like mifepristone – one of two drugs found in Chemical Abortion Pills.
Yet, in probable violation of this law, during the COVID crisis, the Biden Administration abused their control of the FDA to set up No Test, Online Distribution of Chemical Abortion Pills that have led to their widespread use. Now, they make up more than 60 percent of all abortions in America, according to the Guttmacher Institute.
Some states have acted to restrict this, like Louisiana, where the Governor signed into law legislation that made Chemical Abortion Pills a controlled substance.
Even this decision is under fire by the pro-abortion Democrats – just like it did in Idaho, which is what launched this lawsuit around EMTALA in the first place.

It’s important to remember: the endgame is limitless abortion; just look at the Women’s Health Protection Act, which would allow abortions to be committed up until birth nationwide, without any ability for the states to push back, demand taxpayer funding, and trample on the conscience rights of medical professionals.
Likewise, the Democrats have opposed the Born Alive Infants Protection Act – their fealty to corporate abortion (and the dollars Planned Parenthood, among other abortion vendors, put in their pockets) extends to infanticide survivors from botched abortions.
Whether in the Supreme Court or in the halls of Congress, the Democrats are working overtime to ensure that no doctor, nurse, pharmacists, or people can resist this edict. And if the Supreme Court agrees with the Biden Administration, the doors will swing open to even more lawsuits like this one.
