
SFLAction Ask Senators to Stop Death-by-Mail in South Dakota Bathrooms
“A new abortion cartel operates illegally, in and out of the state and even internationally, mailing Chemical Abortion Pills to homes in South Dakota. Abusers just love it, as anonymously purchased, deadly drugs can be slipped to mothers without their knowledge or consent,” noted Students for Life’s Kristan Hawkins. “We are defending innocent preborn babies and their mothers in the new frontier of pro-life leadership, standing against a criminal enterprises designed to profit as people die. South Dakota legislators have a chance at life-saving innovation with our bill.”
PIERRE, S.D. (02-24-2026) – Students for Life Action (SFLAction) President Kristan Hawkins applauded the introduction of the SFLAction-inspired “Anti-Chemical Abortion Pill Trafficking Act” (HB1274), introduced by Rep. John Hughes (R) and Sen. Greg Blanc (R), as part of SFLAction’s push to address the nation’s most common method of abortion today. Representatives passed the “Anti-Chemical Abortion Pill Trafficking Act” by a vote of 61-5. If signed into law, the “Anti-Chemical Abortion Pill Trafficking” would enforce the laws that are already on the books that prohibit prescribing illegal Chemical Abortion Pills in South Dakota, including by out-of-state Chemical Abortion vendors, who then mail the deadly pills across state lines.
“Innovation at the state level proves that elections matter, and we applaud those members of the state House who prioritized protecting women from abusers as well as injury, infertility, and even death. It’s up to the state Senate now. When this is all over, the Pro-Life Generation will educate voters about the action their leaders took, when faced with a chance to protect LIFE. It will take all of us to save lives from Chemical Abortion Pills, the number one method of death by intentional abortion,” said Hawkins.
More than 60% of abortions are committed using Chemical Abortion Pills, killing hundreds of thousands of children and seriously injuring up 1 in 8 mothers who use them. Chemical Abortion Pill vendors openly admit to targeting pro-life states like South Dakota. South Dakota law limits all abortion except in cases of life-threatening medical emergencies.
The Youth Vote, which makes up nearly half of registered voters, finds legislation like the “Anti-Chemical Abortion Pill Trafficking Act” to be important according to a January 2026 Students for Life’s Demetree Institute for Pro-Life Advancement poll released and conducted by Survey USA.
More than 9 in 10 supported a federal review of Chemical Abortion Pills and reinstatement of health and safety standards that have been stripped away from Chemical Abortion Pills, leaving women at risk for injury, infertility, death, and abuse at the hands of those who use the deadly pills against women without their consent. Half of youth voters supported in-person dispensing requirements for Chemical Abortion Pills to protect women from abuse, with only 27% opposing such requirements.
Here is what the “Anti-Chemical Abortion Pill Trafficking Act” would do in South Dakota:
- Prohibit mailing, shipping, or prescribing Chemical Abortion Pills, including from out-of-state sources.
- Classifies committing or attempting to commit an abortion using Chemical Abortion Pills as a felony punishable by up to 10 years imprisonment, or a fine of up to $10,000 per dose, on abortion vendors committing or attempting to commit an abortion using Chemical Abortion on a mother.
- Reinforce state sovereignty over medical regulation.
- Provide remedies including injunctive relief of $10,000 in damages per violation and recovery of court costs and attorney’s fees. Exclude convicted abusers, traffickers, and rapists from bringing such civil actions.
- Allow civil actions to be filed up to three years after the cause of action or one year after any legal stay is lifted.
