Students for Life Action Applauds Kentucky Legislation Targeting Chemical Abortion Pill Trafficking, Calls on Senate Leadership to Pass

Students for Life Action-inspired “Anti-Chemical Abortion Pill Trafficking Act” Would Go After the Businesses of Chemical Abortion Pill Pushers, In & Out of State, To Prevent Death-by-Mail 

 

“In the great tradition of President Abraham Lincoln, Kentucky legislators are standing up to defend LIFE on the human rights issue of our day – abortion,” said Students for Life’s Kristan Hawkins. “This innovative legislation goes after those who have made it a business to profit from death-by-mail. And the Pro-Life Generation will fight by the side of those who once again work to protect the least of these among us.” 

  

FRANKFORT, KY. (02-16-2026) – Students for Life Action (SFLAction) President Kristan Hawkins applauded the introduction today of the “Anti-Chemical Abortion Pill Trafficking Act” (HB 646sponsored by Rep. T.J. Roberts (R) and Rep. Nancy Tate (R). The inspired effort addresses the nation’s number one method of abortion, Chemical Abortion Pills, now often distributed through the mail. If signed into law, the “Anti-Chemical Abortion Pill Trafficking Act” would make prescribing and shipping Chemical Abortion Pills illegal in Kentucky, including by out-of-state abortion vendors peddling the deadly pills across state lines. “The illegal trafficking of Chemical Abortion Pills makes all the wrong people happy, a new abortion cartel and abusers, who use the deadly drugs against mothers without their knowledge or consent,” said Hawkins. “The courage of state legislators to innovate must be met by the commitment of the Trump Administration to finally enforce the Comstock Act and help the states who are working to protect LIFE.”    

Of all reported abortions committed in the U.S., more than 60% are mail-order abortions. Chemical Abortion Pills are responsible for the deaths of hundreds of thousands of preborn children and for seriously injuring up to 1 in 8 mothers who use them. Chemical Abortion Pill vendors are not shying away from the fact they are targeting pro-life states in violation of pro-life laws.  

Voter trends align with this potential crackdown on Chemical Abortion Pill vendors. According to a new Students for Life’s Demetree Institute for Pro-Life Advancement poll conducted by Survey USA, half of youth voters support in-person dispensing requirements for Chemical Abortion Pills to protect women from abuse, with only 27% opposing such requirements. 94% say having a federal review of Chemical Abortion Pill policy is important. 

 

Here is what the “Anti-Chemical Abortion Pill Trafficking Act” will do in Kentucky:   

  • Prohibits mailing, shipping, or prescribing abortifacients, including from out-of-state sources.  
  • Classifies committing or attempting to commit an abortion using an abortifacient on a mother as a felony punishable by up to 10 years’ imprisonment or a fine of up to $100,000.  
  • Reinforces state sovereignty over medical regulation.  
  • Provides remedies including injunctive relief, of $10,000 in damages per violation, and recovery of court costs and attorney’s fees. Excludes convicted abusers, traffickers, and rapists from bringing such civil actions.  
  • Allows civil actions to be filed up to three years after the cause of action or one year after any legal stay is lifted.
